§ 26-43. Businesses not subject to pay the regulatory fee required by this article.

  • The following businesses, and practitioners of professions, and/or occupations are not subject to pay the regulatory fee required by this article, but are required to register with the department:

    (1)

    Any state or local authority;

    (2)

    Any nonprofit organization;

    (3)

    Any vendor operating under a contract with a tax-exempt agricultural fair, as that term is defined in O.C.G.A. § 2-2-8;

    (4)

    Any farm operation for the production from or on the land of agricultural products, but not including any agribusiness;

    (5)

    Architects;

    (6)

    Chiropractors;

    (7)

    Civil, mechanical, hydraulic, or electrical engineers;

    (8)

    Dealers of motor vehicles, as defined in O.C.G.A. § 10-1-622(1);

    (9)

    Dentists;

    (10)

    Embalmers;

    (11)

    Funeral directors;

    (12)

    Land surveyors;

    (13)

    Landscape architects;

    (14)

    Lawyers;

    (15)

    Marriage and family therapists, social workers, and professional counselors;

    (16)

    Merchants or dealers as defined in O.C.G.A. § 48-5-354 as to their deliveries to businesses and practitioners of professions and occupations in areas zoned for commercial use;

    (17)

    Optometrists;

    (18)

    Osteopaths licensed under O.C.G.A. title 43, chapter 34;

    (19)

    Owners or operators of bona fide coin operated amusement machines as defined in O.C.G.A. § 48-17-1, and owners or operators of businesses where bona fide coin operated amusement machines are available for commercial use and play by the public, provided that such amusement machines have affixed current stickers showing payment of annual permit fees, in accordance with O.C.G.A. § 48-17-9;

    (20)

    Physicians licensed under O.C.G.A. title 43, chapter 34;

    (21)

    Podiatrists;

    (22)

    Practitioners of physiotherapy;

    (23)

    Psychologists;

    (24)

    Public accountants;

    (25)

    Those businesses regulated by the Georgia Public Service Commission;

    (26)

    Those electrical service businesses organized under O.C.G.A. title 46, chapter 3; and

    (27)

    Veterinarians.

    (28)

    Any other business, profession, or occupation for which state licensure or registration is required by state law, unless the state law regulating such business or profession, or occupation specifically allows for regulation by local governments.
